Not really. Trolling would indicate a high level of insincerity.

I think whether you're sincere or not matters, unless it's about your sincerity about wanting to derail this thread.

As I said in the old thread, I think the real debate that needs to be settled is defining under what circumstance it's acceptable for a senator to vote no on a nominee. I understand that deference is the tradition, but in the face of what seems like an increased lack of candor by the nominees, I have a hard time just going along with it.

Agreed. I think that's a key question.

Let's suppose that Alito came clean--unambiguously set forth his judicial philosophy including cause and effect. And let's further suppose that however strenuously some of us disagree with his ideology, we grudgingly acknowledge that he demonstrates a command of constitutional law that's commensurate with a SC justice. What then?

In my mind, the litmus test is not whether his ideology squares with mine. It's whether he has the capacity/bearing to sit on the bench and competently render an opinion/interpretation of constitutional law. That's the job.

I also agree that the NY Times is badly out of step on this. What makes it even more glaring, and I think partly helps to explain the overall 'meh' reaction of the American public to Alito's nomination, is the fact that it emanates from the same zealously partisan, 'my way or the highway' ethic that has been the bane of responsible governance--be it in the White House, Congress, or the State Houses. I honestly think that many people are just plain sick of this nonsense and would prefer someone who is competent enough to do the job at hand. That climate is not conducive to Ted Kennedy/Joe Biden chest thumping. That goes for the Times as well.

then again, one could acknowledge that there's a CHANCE stocks will get cut in half from here...even during the good times. true, that probability is higher today than it was, say, one-year ago, let alone 3 or 5 years ago. my point is that that risk is ever-present--it's a question of how you size it.

i guess my related point is that while we can both see the downside risks, we can have different expectations as to probability and, thus, views on how aggressively/flippantly the market has discounted those risks in. while it's perfectly reasonable to dismiss what i wrote upthread as just typical broker-speak/dissembling, suffice it to say that i'm coming at things from a fundamentals-based/bottom-up perspective, not a wing-and-a-prayer. on that basis, it appears that the market has overshot, leaving a number of attractive values in its wake. while i'd stress quality and financial strength in this climate, i am less bearish than you (statement of obvious lol).

Dr. Jimmy and I went to the same elementary school (no ped jokes, please.) Seriously, I wish he still posted a lot. Sure, he liked all of that boring indie rock shit, but he was one of my favorite personalities here. His version of the "confrontational asshole" persona was more restrained and less abrasive than, say, Sickpup's, yet it still managed to turn a lot of people off over the years. I, however, am a proud Jimmy supporter, even though I forgot to vote for him in this poll. A great man.
